General Terms and Conditions of Sale (GTCS) – School, Preschool and Event Caterer Maison Lagnier Traiteur
1. Subject
These GCS govern the contractual relationship between Maison Lagnier Traiteur (hereinafter referred to as ‘the Caterer’) and its customers (hereinafter referred to as ‘the Customer’) for the provision of catering services in the following areas:
School (canteens, one-off events, UAPE)
Pre-school (crèches, nurseries)
Events (weddings, seminars, receptions, birthdays, business events, etc.)
2. Orders
2.1. Quotes and contracts :
For one-off events and event services, a detailed quotation will be drawn up and submitted to the Customer.
For regular school and pre-school services (canteens, crèches, nursery schools, etc.), an annual contract will be drawn up, specifying the terms of service, menus, prices, delivery terms and payment terms.
2.2. Acceptance:
The order is considered firm and definitive once the quotation or contract has been signed by the Customer, accompanied by payment of the deposit (where applicable).
For school and pre-school services, the enrolment of the children or confirmation of the number of children by the school constitutes acceptance.
2.3 Modifications :
Any change to the order (number of guests, menus, timetables, etc.) must be notified in writing and may lead to a revision of the quotation or contract.
For school and pre-school canteens, changes to dietary requirements must be notified when the weekly order is placed.
3. Prices and payment
3.1 Prices : Prices are quoted in Swiss francs (CHF) and include all taxes, unless otherwise stated.
3.2. Deposit : A deposit of 20% may be required on signing the quotation for one-off and special events.
3.3. Invoicing :
For regular school and pre-school services, invoices will be issued on a monthly basis or in accordance with the terms defined in the contract.
For one-off and special events, the balance will be invoiced on the day of the event.
3.4. Payment terms : Invoices are payable within 10 days of their date of issue.
3.5. Late payment: Any late payment may result in the application of late payment penalties calculated at the legal interest rate in force.
4. Cancellation
4.1. Cancellation by the Customer (One-off and Special Events) :
Cancellation conditions and any charges will be specified in the quote.
Charges may be applied depending on how late the cancellation is in relation to the date of the event.
4.2. Cancellation by the Customer (School and Preschool Services) :
Cancellation conditions (in the event of school closure, strike, etc.) will be specified in the contract.
Children’s one-off absences: these must be notified before 9am for the same day, with a maximum of 10% of the initial order tolerated, failing which the meals will be invoiced.
4.3. Cancellation by the Caterer: The Caterer reserves the right to cancel the service in the event of force majeure (unavailability of products, health problems, etc.). In this case, the sums paid by the Customer will be reimbursed in full.
5. Services
5.1. Quality and hygiene :
The Caterer undertakes to comply with current hygiene and food safety standards (HACCP).
5.2. Menus and diets :
Menus will be drawn up in agreement with the Customer, taking into account any dietary restrictions (allergies, specific diets).
For school and pre-school canteens, particular attention will be paid to the nutritional balance of meals and their suitability for young children.
5.3. Delivery and Service :
The times and places of delivery or service will be agreed with the Customer.
The Caterer undertakes to provide a quality service, adapted to the type of event and the age of the guests.
6. Responsibility
6.1. The Caterer’s liability: The Caterer is liable for direct damage caused by its fault or negligence.
6.2. The Customer’s liability : The Customer is liable for any damage caused by his guests or to the equipment made available to him.
7. Force Majeure
Neither party may be held liable for failure to perform its obligations in the event of force majeure (strike, natural disaster, pandemic, etc.).
8. Disputes
Any dispute relating to the interpretation or performance of these GTC shall be submitted to the competent courts of Lausanne.
9. Applicable law
These GTC are governed by Swiss law.
